As applied to residential mortgage loans the foreclosure process is a bank or other secured creditor selling or retrieving a parcel of real property. "Mortgage" or "deed of trust" is when after the owner is defaults to comply the agreement between the lender and the borrower. Default in payment is the common violation of the mortgage, a promissory note is allowed but with a charge on the property.
